It is important that you read the Master Terms & Conditions of Sale (Jane U.S.) ("Terms of Sale" or "Terms") carefully before ordering any products from Jane Jewels, LLC, a Delaware limited liability company ("Jane", "we", "Website" and/or “Product(s)”) through our website www.janejewels.com or sales partners. Together with Jane's Terms of Service, Privacy Policy, and Warranty Terms and Conditions, they govern our relationship with you in relation to this Website and your purchase of Product(s) from the Website.

These Terms define your legal relationship regarding the checkout, the placement of Orders and the purchase of Products. By placing your order to purchase one or more Products (each, an “Order”) through the checkout, you confirm that you have read and understood these Terms of Sale and our Privacy Policy (which is accessible to view and review on the checkout webpage prior to completing each Order) (together, “Order Terms”) in their entirety and you agree to be bound by them. If you do not agree to the Order Terms, please do not complete any Order through the checkout.

Only individuals placing Orders for their own domestic and private use and not their trade, profession, business or craft (“Consumers”, "Customer" or "Client") may purchase Products.

By placing an Order, you confirm you are legally capable (in terms of age and mental capability) of entering into binding contracts per local legal requirements in the place where you reside.

You may have other rights granted by mandatory law, and these Terms of Sale do not affect these except if the two are inconsistent. If this is the case then these Terms of Sale will override any other rights which you may have, unless this is not permitted by law.

For full transparency and accessibility prior to purchase, the Terms of Sale are made readily available and are prominently linked in multiple locations throughout the Jane website, including: (i) in the footer of every webpage under "The Fine Print"; (ii) within the "Delivery & Returns" section on each product webpage, located beneath the product description; and (iii) in the footer links on the checkout webpage.

These Terms of Sale are entered into force in the English language and are governed by it. You agree that any translation, if provided, is available for your convenience only and that Jane is not liable for inaccurate translations provided by a third-party translation software.

1. Availability and Pricing

1.1 All items offered for sale through the Website are subject to availability.

1.2 We reserve the right to impose quantity limits on any Order, reject all or any part of an Order at our sole discretion, and discontinue offering Products without prior notice, even if you have already placed an order for a Product.

1.3 All prices are shown in U.S. dollars and applicable taxes, duties and other charges, if any, are additional.

1.4 All prices are subject to change without notice.

2. Price Adjustments and Price Changes Policy

2.1 Pricing Authority and Modifications

2.1.1 Jane reserves the sole and absolute right, at its discretion and without prior notice, to modify, adjust, or otherwise alter the prices of any and all Products offered for sale, including, but not limited to, changes in the Manufacturer’s Suggested Retail Price (“MSRP”), online pricing, retail pricing, sale pricing, promotional pricing, limited-time discounts, or other pricing variations (collectively, “Price Changes”).

2.2 Non-Applicability of Price Adjustments

2.2.1 Client acknowledges and agrees that all prices for Products are final at the time of purchase. Jane does not offer, provide, or honor any form of price adjustment, credit, refund, rebate, or compensation of any kind as a result of any subsequent Price Changes, including but not limited to:

(a) reductions in price due to sales or promotional offers;
(b) changes in MSRP or standard pricing; or
(c) any other discounts or price variations occurring after the date of the original transaction.

2.3 No Obligation to Match Prior or Future Pricing

2.3.1 Jane shall have no obligation to match any prior or future pricing for any Product previously purchased by Client, nor shall Jane have any obligation to notify Client of upcoming Price Changes.

2.4 Finality of Transactions

2.4.1 All transactions are deemed final at the time payment is successfully processed. Client expressly waives any right to request, demand, or otherwise claim a price adjustment, partial refund, credit, or similar remedy based on Price Changes occurring at any time before or after the date of purchase.

2.5 Reservation of Rights

2.5.1 Jane expressly reserves all rights to modify or discontinue products, promotions, or pricing structures at any time, without obligation or liability to Client, except as otherwise required by applicable law.

3. Order Processing

3.1 Fulfillment and Processing Time Standards

3.1.1 Orders for Products marked as In Stock placed through the Website are generally processed and shipped within approximately twenty-four (24) to forty-eight (48) business hours following order confirmation.

3.1.2 Orders are processed and shipped exclusively on business days, defined as Monday through Friday, excluding weekends and federal holidays. Orders submitted on a Friday, Saturday, or Sunday are generally processed and shipped on the following Monday.

3.1.3 Notwithstanding the foregoing, during periods of high order volumes, processing and shipping times may be extended to approximately two (2) to three (3) business days. In exceptional circumstances, including but not limited to peak promotional periods, order processing and shipment may require up to a maximum of five (5) business days.

3.1.4 This excludes any Products explicitly designated as Made to Order at the time of purchase. Products explicitly designated as Made to Order at the time of purchase are subject to extended production lead times as stated on the product webpage and are not bound by the standard processing period referenced above.

3.1.5 By submitting an Order, Client expressly acknowledges and agrees that all orders for Products marked as In Stock—regardless of the shipping method selected, including expedited shipping options—may require up to five (5) business days to be processed prior to shipment ("Standard Order Processing Window"). Accordingly, under no circumstances shall the standard processing time of up to five (5) business days serve as valid grounds for cancellation, refund, chargeback, or any other form of compensation. This provision is a binding term of sale and is deemed accepted by the Client at the time the Order is submitted.

3.1.6 For the avoidance of doubt, Products designated as Made to Order are subject to a separate production lead time, as specified on the Product page or otherwise communicated to the Client. Upon completion of the applicable production lead time, such Made to Order Products are also subject to the standard processing time of up to five (5) additional business days prior to shipment. The production lead time and the processing time do not run concurrently. Under no circumstances shall this post-production processing period be considered grounds for cancellation, refund, chargeback, or any other form of compensation. This condition is a material term of sale and is deemed unconditionally accepted by the Client at the time the Order is submitted.

3.2 Processing and Delivery Impact of U.S. Federal Holidays

3.2.1 Orders placed on, or within close proximity to, a United States federal holiday may be subject to additional processing and delivery timeframes.

3.2.2 Jane’s fulfillment centers are closed in observance of all U.S. federal holidays. As such, any orders placed on, or up to two (2) business days immediately preceding, a federal holiday may incur an extended processing window of up to five (5) additional business days. Furthermore, delays in transit may occur due to limited or suspended operations of third-party shipping carriers during such holidays; this is a standard, industry-wide occurrence that is entirely beyond Jane's control. In such instances, deliveries may be further delayed by an estimated two (2) to five (5) additional business days. Jane shall not be held liable for any delays in processing or delivery arising from the observance of U.S. federal holidays, whether on the part of Jane or any third-party shipping provider. Such delays shall not constitute grounds for order cancellation, refund, chargeback, credit, or any other form of financial compensation or legal remedy. This provision forms an express and binding term of sale and shall be deemed accepted upon placement of any Order.

3.2.3 Where an expedited shipping method is selected at checkout, the order will be shipped via the corresponding expedited service offered by the third-party shipping carrier. However, the Client expressly acknowledges and agrees that any delays in transit resulting from limited or suspended operations of shipping carriers during or surrounding U.S. federal holidays are industry-standard occurrences and are entirely beyond Jane’s control. Such delays shall not constitute a failure on the part of Jane to fulfill its obligation to purchase and apply the expedited shipping service selected by the Client. Accordingly, no refund, cancellation, chargeback, or other remedy shall be available due to any deviation in delivery timing caused by third-party carrier delays during federal holidays. This provision is a binding term of sale and is deemed accepted by the Client upon placement of the order.

3.2.4 All U.S. federal holidays are: New Year’s Day (January 1), Martin Luther King Jr. Day (third Monday in January), Presidents’ Day (third Monday in February), Memorial Day (last Monday in May), Juneteenth National Independence Day (June 19), Independence Day (July 4), Labor Day (first Monday in September), Columbus Day (second Monday in October), Veterans Day (November 11), Thanksgiving Day (fourth Thursday in November), and Christmas Day (December 25). Clients placing orders in close proximity to a U.S. federal holiday are advised to plan accordingly, as processing and/or shipping delays may occur during such periods.

3.3 Mixed-Availability Orders

3.3.1 Orders will be shipped in their entirety once all Products included in the Order are available for shipment.

3.3.2 In the event that an Order contains both Products that are marked as In Stock and Products that are marked as Made to Order, the Order will be shipped only when all the Products that are marked as Made to Order have been completed and all are ready for dispatch.

3.3.3 You may request a partial shipment of Products that are marked as In Stock in advance of Products that are marked as Made to Order for an additional split-shipping fee of $20.00 USD. Subsequent payment is required prior to a split dispatch. To request split shipping, contact the Concierge team at concierge@janejewels.com.

3.4 Extended Processing Time for International Orders

3.4.1 For international shipments, please allow an additional one (1) to three (3) business days beyond the Standard Order Processing Window for the preparation and completion of the required customs documentation by our International Exporting Department. Such documentation is necessary to ensure proper customs clearance and duty assessment upon arrival in the destination country.

3.5 Expedited Delivery Applies Only to Carrier Transit Time

3.5.1 Please be advised that the selection of an expedited shipping method, including but not limited to Express Shipping and Overnight Shipping, at the checkout does not shorten the production lead time for Products that are marked as Made to Order, nor does it shorten the standard order processing time. Production timelines are separate and independent from the shipping method selected. The shipping method solely governs the estimated transit time provided by the third-party shipping carrier and does not influence the time required to prepare the Product(s) for shipment. This is a binding term of sale, and the timely processing of an order within the stated production and handling timeframes—regardless of the shipping method selected—shall not constitute grounds for cancellation, refund, chargeback, or any other form of compensation.

4. Order Cancellation and Modification

4.1 Order Change and Cancellation Requests

4.1.1 All Clients are hereby advised to carefully review their selections as well as the billing and shipping information they provide at the checkout prior to completing a purchase. Once an Order has been submitted, it is deemed final and may not be modified, canceled, or otherwise altered under any circumstances. To facilitate the prompt processing and timely fulfillment of all Orders (as well as timely production of Products that are marked as Made to Order), Orders are processed immediately upon confirmation. This policy is strictly enforced and applies without exception to all product types, including but not limited to Products that are marked as In Stock and Made to Order.

4.1.2 By selecting “Pay Now” at checkout, you expressly acknowledge and agree that you are entering into a binding and enforceable agreement to purchase the selected Products. This action is final, non-cancellable, and non-reversible.

4.2 Address Accuracy and Irrevocability of Shipping Details

4.2.1 All Clients are solely responsible for ensuring the accuracy and completeness of all shipping information provided at the time of checkout, including but not limited to recipient name, street address, apartment or unit number, postal code, country, and contact information. By submitting an Order, you acknowledge and agree that the information entered will be used exactly as provided for the fulfillment and shipment of your purchase.

4.2.2 Once an Order has been submitted and payment confirmed, Jane is unable, under any circumstances, to modify, correct, or amend any shipping address, recipient information, or other details associated with that Order. This includes requests submitted immediately after placing the Order or within minutes thereof. All Orders are automatically and irreversibly transmitted to our fulfillment system and third-party logistics partners upon confirmation to ensure timely dispatch. Accordingly, address change requests received at any time following submission cannot be accommodated, regardless of the urgency, reason, or timing of the request.

4.2.3 Orders are processed and transmitted to our fulfillment centers immediately upon confirmation to ensure rapid dispatch and adherence to our delivery timeline standards. Accordingly, Jane cannot intercept, modify, or re-route an Order once it has entered processing or fulfillment, and we shall not be held liable for any delays, misdeliveries, or losses arising from inaccurate or incomplete address details provided by the Client.

4.2.4 In the event that an Order is returned to Jane due to an incorrect or undeliverable address, such Order shall be treated as abandoned and non-refundable. Reshipment, if available, will be considered a new and separate transaction subject to full repayment of the shipping costs.

4.3 Post-Purchase Promotional Code Policy

4.3.1 Promotional codes and special offers must be applied at the time of purchase and prior to Order submission. Discounts, promotional pricing, or special offers cannot be applied retroactively or adjusted after an Order has been submitted, regardless of any subsequent request.

4.4 Adding Items to an Existing Order

4.4.1 Should you wish to purchase additional Products after submitting an Order, a separate and new Order must be placed for such items. Product additions to existing Order are not permitted.

4.5 Return Restrictions for Incorrectly Ordered Items

4.5.1 In the event you inadvertently make an error when submitting your Order, such error shall not constitute grounds for Order cancellation or refund. Any Products ordered in error may only be returned in accordance with the applicable return terms and conditions set forth in these Terms of Sale, which may permit return for store credit only, where eligible. No exceptions shall be made. By selecting “Pay Now” at checkout, you expressly acknowledge and agree that you are entering into a binding and enforceable agreement to purchase the selected Products. This action is final, non-cancellable, and non-reversible.

4.5.2 Jane is not liable for any Client's inadvertent errors made when placing an Order.

5. Delivery, Shipping Timeline, and Risk of Loss

5.1 Estimated Dispatch Schedule

5.1.1 Jane is committed to providing a seamless shipment experience. This starts with our commitment to dispatch all Products that are marked as In Stock within one (1) business day from the date of order confirmation; provided, however, that certain exclusions may apply. For additional details, please refer to the Order Processing section above, which forms an integral part of these Terms of Sale.

5.2 Partial Deliveries

5.2.1 Jane shall be entitled to partial deliveries, and Client hereby accepts partial deliveries.

5.3 Limitation of Liability for Carrier and Transit Delays

5.3.1 Upon dispatch from Jane, orders are transferred to third-party shipping carriers such as the United States Postal Service (USPS), United Parcel Service, Inc. (UPS), FedEx Corporation (FedEx), or Deutsche Post AG (DHL) ("Third-Party Shipping Carrier"). As such, they are no longer in the possession of Jane. Once an Order is in the possession of a Third-Party Shipping Carrier, Jane is not liable for delays, disruptions, or delivery failures attributable to Third-Party Shipping Carrier operations, transit protocols, or customs clearance procedures. This includes, but is not limited to, delays caused by international tariffs, customs inspections, or other regulatory actions outside Jane's control. Jane is not a Third-Party Shipping Carrier itself and does not hold any control over the operations, handling, or routing decisions made by Carriers or customs authorities, nor does Jane hold any insights into Third-Party Shipping Carrier operations other than the information publicly available on the tracking webpage.

5.3.2 Jane shall not be held responsible or liable for any delays in shipment, delivery, or transit of any order, whether such delays are caused by Third-Party Shipping Carriers, customs authorities, weather conditions, labor disputes, supply chain disruptions, governmental actions, or any other circumstances beyond Jane’s reasonable control. Estimated delivery dates are provided for convenience only and do not constitute a guarantee. Under no circumstances shall such delays constitute grounds for cancellation, refund, chargeback, or any form of compensation. This provision constitutes a binding term of sale.

5.3.3 Unless explicitly stipulated in writing by Jane, the delivery dates indicated by Jane shall only be non-binding estimates, made to the best of Jane's knowledge per the guidance of Third-Party Shipping Carrier. Should a delivery be delayed beyond the dates explicitly confirmed by Jane in writing, Client shall set a grace period of at least thirty (30) consecutive business days to receive delivery. After expiry of such grace period, Client may request a replacement. Any further claims are excluded.

5.4 Dormant Shipments

5.4.1 In the event that a package remains in transit without movement for a period of thirty (30) consecutive business days, Jane will issue a one-time complimentary replacement for the affected item(s), subject to product availability and completion of the investigation with the Third-Party Shipping Carrier. As Third-Party Shipping Carrier operations are completely outside of Jane's control and represent a mutual loss of the Order shipped, refunds are not issued for lost or delayed packages and the sole and exclusive remedy shall be in the form of a Product replacement. By completing an Order, Client agrees to these Terms, which constitute a binding condition of sale.

5.5 Disclaimer of Responsibility for Shipping-Related Errors

5.5.1 This policy shall not apply to shipments that are (i) dispatched to an incorrect shipping address provided by the Client, or (ii) delayed, refused, or otherwise impacted due to the Client’s failure to provide accurate government-required identification or other required documentation for destination countries where such information is mandatory. In the event a shipment is refused, delayed, or lost as a result of the Client’s error or omission, all costs and expenses associated with the return and reshipment of the Product(s) to Jane shall be the sole responsibility of the Client.

5.6 Title and Risk of Loss; Shipping Carrier Liability

5.6.1 Once an Order has been fulfilled and a tracking number has been issued, Jane's responsibility for the parcel ends. Title and risk of loss for the merchandise pass to the Client upon Jane's transfer of the package to the third-party shipping carrier. If the carrier confirms delivery to the shipping address provided at checkout, Jane shall bear no liability for any claims of loss, theft, or misdelivery thereafter.

5.6.2 Resolution of any such issues must be pursued directly with the shipping carrier. Jane is responsible solely for the production and dispatch of your order; the carrier assumes all responsibility for successful delivery. By completing a purchase with Jane, you acknowledge and agree to these terms in full.

6. Return and Exchange Policy

6.1 General Return and Exchange Policy

6.1.1 Jane accepts returns for store credit or exchange only, provided such returns are initiated within seven (7) days from the date of delivery recorded by the Third-Party Shipping Carrier. Refunds are expressly not offered. To ensure full transparency prior to purchase, this policy is prominently disclosed on each product page within the "Delivery & Returns" section, at the checkout, and via a link in the footer of every webpage on the Jane website (under "The Fine Print").

6.1.2 For the avoidance of doubt, the seven (7) day return period begins on the calendar day the shipment is marked as “Delivered” by the Third-Party Shipping Carrier. The delivery date shall be considered the first day of the seven-day period.

6.2 Return Eligibility

6.2.1 All Products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them. We are unable to accept any return if the Product shows any signs of wear or has been used or altered (including third-party modifications or repairs) from its original condition in any way. Products must be accompanied by all original packaging and instructions leaflets for a return to be accepted (including jewelry boxes and pouches).

6.3 Final Sale

6.3.1 Please be advised that Products that are personalized, altered, engraved, and marked as Made to Order, as well as fine jewelry and products designated as Final Sale, are strictly non-returnable and non-exchangeable. Additionally, certain limited edition, sale and collaboration merchandise may be excluded from refund eligibility.

6.4 Restocking Fee and Return Shipping

6.4.1 A restocking fee of twenty United States dollars (USD $20.00) will apply to each returned order and will be deducted automatically from the total credit or exchange value. Return shipping is complimentary for orders delivered within the United States and Canada; a prepaid return shipping label will be provided at the time the return is submitted. For all other international returns, the Client shall bear full responsibility for the cost of return shipping.

6.5 How to Start a Return

6.5.1 To initiate a return or exchange, please visit the Returns & Warranty Center located at returns.janejewels.com within seven (7) days from the date of delivery.

7. Disclosure of Extended Lead Times for Made to Order Merchandise

7.1 Acceptance of Goods Subject to Delay

7.1.1 Notwithstanding any estimated lead times indicated on the product webpage, all Products marked as Made to Order are subject to unpredictable and volatile conditions including, but not limited to, international customs procedures, fluctuating government-imposed tariffs, duties, import taxes, and overseas shipping delays, all of which can result in supply chain delays which are beyond the control or responsibility of Jane. Accordingly, the Client expressly acknowledges and agrees that dispatch of Products marked as Made to Order may require up to twelve (12) weeks from the date of purchase.

7.1.2 We share your enthusiasm for your new Jane and are committed to ensuring it reaches you as promptly as possible.

7.2 Binding and Final Nature of Made to Order Product Transactions

7.2.1 Client further understands and agrees that all Made to Order sales are final, non-refundable, and non-cancellable within such twelve (12) week period, irrespective of any delays arising from circumstances outside Jane’s control.

7.2.3 All materials utilized in the creation of made-to-order Products—including precious metals, diamonds, and gemstones—are specially sourced and allocated exclusively for the Client’s order. As such, these materials are non-refundable, and the sale shall be deemed final.

8. Responsibility for Customs Duties, Taxes, and Import Fees

8.1 Client's Obligation for Duties and International Taxes

8.1.1 Clients intending to export Products purchased from Jane bear sole responsibility for ensuring full compliance with all applicable export laws, regulations, and requirements.

8.1.2 For all international orders, product prices and shipping fees expressly exclude any import duties, customs fees, Value Added Tax (VAT), tariffs, brokerage fees, or other charges that may be levied by the destination country or Third-Party Shipping Carriers upon importation.

8.1.3 Jane does not bear any liability for such charges, as well as for any delivery delays resulting from customs processing.

8.2 Client Responsibility for Refused or Returned International Shipments

8.2.1 In the event a shipment is refused or returned due to unpaid government-imposed fees or non-compliance with import regulations, all associated costs, including return shipping fees, shall be borne exclusively by the Client. The recipient of the order is deemed the importer of record and is solely responsible for compliance with all import laws, regulations, and requirements of the destination country.

8.3 Effect of Shipment Refusal or Return on Final Sale Orders

8.3.1 If a shipment is refused by the Client, returned to Jane, or otherwise not accepted, whether at the designated point of delivery, at customs, or at any subsequent stage in the shipping or delivery process, such refusal, return, or failure to accept delivery—including, without limitation, any refusal or failure by the Client to remit payment of duties, taxes, tariffs, or other government-imposed charges—shall under no circumstances be deemed, construed, or interpreted as a valid return, exchange, or cancellation of the Order. Orders expressly designated and sold as “Final Sale” shall remain irrevocably non-cancellable, non-returnable, and non-refundable, without exception and irrespective of delivery status, attempted delivery, or Client’s acceptance thereof.

8.3.2 The Client acknowledges and expressly agrees that all financial and logistical consequences arising from or related to any refusal, non-acceptance, or return of a shipment—including, but not limited to, carrier-imposed return charges, redelivery or re-shipping fees, international or domestic duties, taxes, tariffs, brokerage fees, storage fees, and any other ancillary costs incurred—shall be borne exclusively and in full by the Client. For avoidance of doubt, and as referenced in other provisions of these Terms of Sale, the Client bears sole and explicit responsibility for all government-imposed duties, taxes, and related charges, and any failure or refusal to pay such charges shall not, under any circumstance, excuse the Client from the binding and final nature of the transaction. At no time shall Jane be obligated to absorb, offset, credit, or otherwise assume any portion of such costs, nor shall such circumstances entitle the Client to any refund, credit, or waiver of fees.

9. Imperfect Fulfillment and Remedy

9.1 Reporting Requirements for Damaged Goods

9.1.1 In the event that any Product is reported to be received in a damaged condition, Client must notify Jane’s Concierge team within forty-eight (48) hours of delivery. Jane reserves the right to decline any damage claims submitted after the forty-eight (48) hour notification period following the delivery date recorded by the Third-Party Shipping Carrier in order to maintain the integrity of the claims process and prevent potential fraudulent or unverifiable reports.

9.1.2 To initiate a damage claim, Client shall submit a written notice via email to concierge@janejewels.com, including: (i) multiple clear photographs evidencing the damage, encompassing all packaging components; (ii) a description of the damage; (iii) a photograph of the packing slip; and (iv) the order confirmation number.

9.2 Retention Requirement of Packaging and Evidence for Claims Review

9.2.1 Client is required to retain the entire shipment, including all packaging materials and boxes, until the claim is fully resolved. Jane reserves the right to request additional photographic evidence to substantiate the claim. Should any portion of the packaging be discarded prior to such request, and supplemental evidence thereby be unavailable, Jane reserves the right to deny the claim.

9.3 Exclusive Remedy for Transit-Damaged Products

9.3.1 The sole and exclusive remedy for any product damaged during transit is limited to replacement of the product; refunds are not provided under any circumstance.

9.4 Reservation of Rights to Reject Unverifiable Claims

9.4.1 Jane reserves the sole discretion to deny any claim if it is unable to verify that the damage occurred during transit.

10. Incorrect item received or missing item

10.1 In the rare event that an incorrect item is received or your shipment is missing an item, please contact our Concierge team within 48 hours of delivery. We are here to assist and are committed to resolving the issue promptly.

10.2 To initiate a claim, kindly email us at concierge@janejewels.com and include multiple clear photographs of what was received, a photo of your packing slip (please note this is essential, as orders may be shipped in separate packages depending on lead times), and your order confirmation number.

10.3 Please retain the entire shipment and all original packaging components—including the shipping box, inserts, and any received products—as we may request additional photographs to support the review of your claim. If any part of the packaging is discarded and supplemental photos cannot be provided upon request, your claim may be subject to denial.

10.4 Please note that Jane reserves the right to decline replacement requests if notification is received more than 48 hours after the delivery time recorded by the shipping carrier.

11. European Union 14 day cooling off period

11.1 Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. 12. Gift Cards

12.1 These Terms and Conditions (“Terms”) govern the purchase, use, and redemption of Jane Jewels gift cards (“Gift Cards”). By purchasing, accepting, or using a Gift Card, you agree to be bound by these Terms. Please read them carefully.

12.2 Jane Jewels, LLC (“Jane,” “we,” “us,” or “our”) issues and administers all Gift Cards. Gift Cards are distributed by Jane Jewels directly or through authorized third-party sellers.

12.3 Jane offers physical and/or electronic Gift Cards ("Jane Digital Gift Card"). Both are governed by these Terms.

12.4 Gift Cards may be purchased online at https://janejewels.com/collections/gift-cards or through authorized partners.

12.5 Jane Digital Gift Cards will be delivered to the email address provided at the time of purchase. Jane is not responsible for non-delivery due to incorrect or incomplete email addresses.

12.6 Physical Gift Cards will be shipped to the designated shipping address. Delivery times may vary.

12.7 Gift Cards are redeemable solely for merchandise available at https://janejewels.com/ and may not be redeemed for cash or credit, except where required by law.

12.8 Gift Cards cannot be used to purchase other Gift Cards.

12.9 To redeem a Gift Card, enter the code at checkout. Any unused balance will remain on the card for future use, subject to these Terms.

12.10 You may check your Gift Card balance at any time by contacting our Concierge client services team at concierge@janejewels.com.

12.11 Jane Gift Cards do not expire and are not subject to service or inactivity fees, unless otherwise required by law.

12.12 No additional fees are charged for the purchase or use of a Gift Card.

12.13 Gift Cards cannot be reloaded, resold, transferred for value, or applied to any credit or debit account.

12.14 Gift Cards are not redeemable for cash, except as required by law.

12.15 Gift Cards may not be used for unauthorized or unlawful purposes, including fraudulent transactions.

12.16 The risk of loss and title for Gift Cards passes to the purchaser upon electronic transmission or delivery to the carrier. Jane is not responsible for lost, stolen, damaged, or unauthorized use of Gift Cards. Treat your Gift Card like cash.

12.17 All Gift Card purchases are final. Gift Cards cannot be returned, exchanged, or refunded, except where required by law.

12.18 Jane reserves the right to refuse to honor or to deactivate any Gift Card obtained fraudulently or suspected of unlawful activity, without refund or compensation.

12.19 Jane makes no warranties, express or implied, with respect to Gift Cards, including any warranty of merchantability or fitness for a particular purpose. In the event a Gift Card code is non-functional, your sole remedy and our sole liability shall be the replacement of such Gift Card.

12.20 Jane reserves the right to modify these Terms at any time without prior notice, to the extent permitted by applicable law. Changes will be posted at https://janejewels.com/policies/refund-policy. Continued use of the Gift Card after any such changes constitutes acceptance of the revised Terms.

13. Post-Purchase Communications, Remedies, and Client Response Obligations

13.1 Acknowledgment of Remedies and Cooperation Requirement

13.1.1 Client expressly acknowledges and agrees that, following any purchase of goods or services from Jane, Jane may, in its sole and absolute discretion, elect to provide assistance, remedies, or resolutions in connection with any matter arising from or related to the Client's purchase, including, without limitation, any inquiry, claim, concern, complaint, request, or situation of any nature whatsoever (collectively, “Issues”), and that such assistance or resolution may include, without limitation, a refund, credit, discount, replacement, repair, or other form of remedial action (collectively, “Remedies”). Client further acknowledges that any provision of Remedies by Jane is contingent upon the Client's timely, good faith, and reasonable communication and cooperation with the Company.

13.2 Timely Response Obligation

13.2.1 Client expressly agrees that, upon Jane's provision of any written communication, correspondence, or notice (including, without limitation, by email) regarding any Issue or proposed Remedy, Client shall provide a substantive response within ten (10) consecutive business days from the date of Jane's communication in each instance. Client agrees that this ten (10) business day period constitutes a reasonable period within which Client may respond under all circumstances. Client further acknowledges and agrees that failure to respond within this timeframe constitutes a material breach of Client's obligations under these Terms.

13.3 Right to Void Remedies

13.3.1 In the event of Client's failure to respond within the prescribed timeframe, Client expressly agrees and acknowledges that Jane, in its sole and absolute discretion, may (i) cancel, void, withhold, or otherwise refuse to provide any or all Remedies; (ii) deem any previously offered Remedies null, void, or expired; and (iii) cease any evaluation, verification, or processing of the Issue. Client acknowledges that such actions are justified by, among other reasons: (a) the expiration of the Company’s ability to verify, inspect, or otherwise substantiate the Issue; (b) the inability of the Company to maintain the integrity, accuracy, and validity of its post-purchase claims process; and (c) the necessity of timely communication to effectuate meaningful resolution.

13.4 No Exceptions or Extensions

13.4.1 Client further agrees that the ten (10) consecutive business day response period is non-negotiable, final, and enforceable, and that no extension, exception, or modification shall be binding on Jane unless expressly provided in writing by an authorized representative of Jane. Client acknowledges that Jane's rights and remedies under this Section are cumulative, non-exclusive, and enforceable in addition to all other rights and remedies available under law, equity, or contract.

13.5 Waiver of Remedies

13.5.1 By failing to respond within the prescribed period, Client expressly waives, relinquishes, and forfeits any entitlement to any Remedies, and acknowledges that Jane shall have no further obligation, liability, or duty to provide any assistance or resolution regarding the Issue. Client further acknowledges that this waiver is effective immediately upon the expiration of the ten (10) consecutive business day period and that any prior representations, offers, or communications regarding Remedies shall be rendered null and void.

13.6 Material Condition

13.6.1 Client acknowledges and agrees that compliance with the obligations set forth in this Section is a material condition of eligibility for any post-purchase Remedies, and that Jane may rely upon Client's adherence to such obligations in determining whether to provide, continue, or withdraw any Remedies. Client expressly acknowledges that any failure to comply shall not give rise to any claim, cause of action, or demand against Jane.

13.7 Cross-Reference to Other Policies and Remedies

13.7.1 Client expressly acknowledges and agrees that the obligations, rights, and remedies set forth in this Section operate in conjunction with, and are fully incorporated into, all other Jane policies, procedures, and terms, including, without limitation, Jane's Terms of Sale, Warranty Terms and Conditions, Promotional or Sale Terms, and any other post-purchase or customer service provisions set forth in these Terms of Sale or otherwise communicated by Jane (collectively, “Company Policies”). Client further acknowledges that any failure to comply with the timely response requirements of this Section shall, without limitation, operate to limit, void, or waive any entitlement under any Company Policies, and that Jane may enforce such rights in its sole discretion. Client agrees that this cross-reference is intended to ensure the consistency, integrity, and enforceability of all post-purchase rights and remedies, and that adherence to the obligations herein is a condition precedent to any claim or entitlement under any Company Policy.

14. Damaged Packaging Policy

14.1 Condition of Packaging at Shipment Origin

14.1.1 All orders dispatched from Jane are processed, packed, and sealed in accordance with internal quality-assurance and control standards. At the time of departure from our facility, packaging components are inspected and confirmed to be free of defects, tears, rips, creasing, or other physical damage. Jane exercises reasonable care in securing and preparing all parcels for transit.

14.2 Condition of Packaging at Shipment Origin

14.2.1 Upon transfer of shipments to a third-party carrier, control of the physical parcel leaves the possession of Jane. Jane does not and cannot supervise or influence the manner in which any carrier handles, transports, stores, or delivers packages. As a result, packaging materials may, on occasion, arrive in a condition that differs from their condition at dispatch, including but not limited to wrinkled or torn tissue paper, shifted internal components, or wrinkled/creased documentation. Jane shall not be held liable for cosmetic or incidental damage of any kind sustained by packaging while in transit, and responsibility for such carrier-caused damage is hereby expressly disclaimed.

14.3 Condition of Packaging at Shipment Origin

14.3.1 In the event a client receives a shipment with damaged packaging but intact merchandise, the client must notify Jane within twenty-four (24) hours of the time and date the shipment is marked as delivered by the carrier’s tracking records. Notification must include a clear description of the damage and include photographic evidence.

14.3.2 Failure to provide notice within the specified 24-hour period shall result in automatic denial of any related claim, as Jane is unable to reasonably verify the integrity or accuracy of claims submitted outside this time window.

14.4 Retention of Packaging Materials

14.4.1 Customers are required to retain all original packaging materials—including damaged components—until Jane confirms closure of the claim. Jane reserves the right to request additional photographs, documentation, or other supplemental proof. Failure to retain or supply requested materials may result in denial of the claim.

14.5 Available Remedies and Limitations

14.5.1 Subject to timely notification, evidence review, and approval of claim, Jane may, at its sole discretion, issue replacement packaging components only, limited specifically to the items determined to be damaged (e.g., tissue paper, jewelry box, branded insert).

14.5.2 Under no circumstance will Jane provide a refund, store credit, exchange, replacement jewelry, or any remedy beyond the replacement of damaged packaging components. Jewelry items that arrive in undamaged and acceptable condition are deemed fully delivered and fulfilled, regardless of packaging condition.

14.6 Final Authority

14.6.1 Jane shall maintain full and exclusive discretion in determining claim validity and the appropriate remedy, if any. Submission of a claim does not guarantee approval or replacement materials.
